Roamli Scavenger Hunt Terms & Conditions

Please read these Terms & Conditions carefully.

These Terms & Conditions were last updated on August 31, 2026 and take effect on September 30, 2026. Until then, the previous version applies. Roamli may update these Terms & Conditions from time to time. Roamli will give notice of any material change by e-mail or on the Roamli website, and a material change will take effect 30 days after it is posted. Participating in a Scavenger Hunt Experience after a change takes effect constitutes acceptance of the updated Terms & Conditions.

These Terms & Conditions (including the Publicity and User Content Release set forth in the Section titled “Release of Photographs, Likenesses and User Content” and, where applicable, the parent/guardian consent set forth in the Section titled “Participation by Minors; Parent/Guardian Consent”), taken together with the Official Rules for Roamli Scavenger Hunt Experience (to the extent applicable to a given Scavenger Hunt Experience), constitute a binding agreement as to your participation, and the participation of any Minor on whose behalf you accept them, in the Roamli Scavenger Hunt Experience. DO NOT PURCHASE GAME PLAY MATERIALS, PARTICIPATE IN THE ROAMLI SCAVENGER HUNT EXPERIENCE, OR ALLOW A MINOR IN YOUR CARE TO PARTICIPATE UNLESS YOU HAVE READ, UNDERSTAND AND AGREE TO THESE TERMS & CONDITIONS AS WELL AS THE OFFICIAL RULES FOR THE ROAMLI SCAVENGER HUNT EXPERIENCE. These Terms & Conditions and the Official Rules supersede any prior understandings or agreements, whether oral or written, as to such participation. The terms of the Official Rules are incorporated herein by reference. No separate publicity release form is required: any reference in the Official Rules or in any other Roamli materials to a “Publicity Release Form” refers to the Publicity and User Content Release contained in these Terms & Conditions. My use of the Roamli website and platform generally remains subject to the Roamli Terms of Use and Privacy Policy; in the event of any inconsistency between those documents and these Terms & Conditions with respect to a Scavenger Hunt Experience or User Content, these Terms & Conditions shall prevail. In the event of any inconsistency between these Terms & Conditions and the Official Rules, these Terms & Conditions shall prevail, govern and control in all respects.

Definitions: As used in these Terms & Conditions, consistent with the Roamli Terms of Use: (a) “Scavenger Hunt Experience” means a scavenger hunt, tour, challenge, competition, or other Event (as defined in the Roamli Terms of Use) that Roamli itself conducts, including Roamli’s ticketed and prize competitions, and Roamli is the Event Creator (as defined in the Roamli Terms of Use) of each Scavenger Hunt Experience. These Terms & Conditions do not apply to Events created or run on the Roamli platform by other Event Creators, which are governed by the Roamli Terms of Use, Privacy Policy, and Community Standards; (b) “Participant” means anyone who joins, plays, or otherwise takes part in a Scavenger Hunt Experience, whether individually or as a member of a group/team, including a group/team member who plays without a Roamli account of his/her own, and includes each Contestant and each Minor, and references herein to “Contestants” include all Participants; (c) “Minor” means an individual who is under 18 years of age (or under the age of majority in his/her jurisdiction of residence, whichever is higher); (d) “User Content” means any photographs, videos, audio, text, captions, answers, comments, messages, and other materials submitted, uploaded, posted, or transmitted through the Roamli platform in connection with a Scavenger Hunt Experience by or on behalf of a Participant (including through another person’s Roamli account), and User Content submitted as an answer to a Challenge is a “Submission”; and (e) “I,” “me,” and “my” refer to the individual accepting these Terms & Conditions and, where that individual accepts them on behalf of a Minor, also to the Minor, as the context requires.

In consideration of being allowed to participate (or of a Minor on whose behalf I accept these Terms & Conditions being allowed to participate) in the Roamli Scavenger Hunt Experience conducted by Roamli LLC (“Roamli”), Evanston, IL 60201, I acknowledge, warrant and agree to the following:

  1. Requirements for Scavenger Hunt Experience Contestants:

    Accounts. A Roamli account may only be created or held by an individual who is 18 years of age or older (or the age of majority in his/her jurisdiction of residence, whichever is higher). By creating or using a Roamli account, I certify and warrant that I meet this requirement. A Minor may not create or hold a Roamli account, and Roamli may suspend or close any account that it reasonably believes was created or is held by a Minor.

    Adult Participants. If I am participating on my own behalf, I must (1) be 18 years (or age of majority in my jurisdiction of residence, whichever is higher) or older (2) have the power to enter a binding contract with Roamli and not be barred from doing so under any applicable laws or any other agreement to which I am a party, and (3) reside in the United States. By my participation in the Scavenger Hunt Experience, I affirmatively certify and warrant that I am 18 years of age or older (or age of majority in my jurisdiction of residence, whichever is higher), have the power to enter a binding contract with Roamli and reside within the United States.

    Minor Participants. A Minor may participate in a Scavenger Hunt Experience only if the Minor’s parent or legal guardian has approved the Minor’s participation and has accepted these Terms & Conditions on the Minor’s behalf as set forth in the Section titled “Participation by Minors; Parent/Guardian Consent” below. The Minor must meet the requirements of this Section other than the age and contractual-capacity requirements, and the Minor’s parent or legal guardian makes the certifications and warranties in this Section on the Minor’s behalf. Roamli relies on the Lead Contestant, or on the adult account holder through whose account the Minor participates, to obtain and confirm that approval, as provided below.

    I further certify and warrant that I am not:

    1. A current or former employee, officer, director, owner or independent contractor of any vendor or other service provider of Roamli or a member of the same household (whether or not related) or Family Member (defined as parent, child, sibling, spouse, regardless of where I may live) of any of the foregoing.

    2. A current or former employee, officer, director, owner or independent contractor of any Scavenger Hunt Experience producers, sponsors, organizers other than Roamli (to the extent applicable);

    3. In possession of any knowledge of the game play materials or location of the Challenges comprising the Scavenger Hunt Experience prior to Roamli’s provision of same to Contestants at the time of purchase;

    4. Subject to a felony conviction or a conviction of any kind for trespassing, larceny, sexual assault or domestic violence that has not been overturned or;

    5. Currently registered, or required to register, as a sex offender.


    You may participate in a Scavenger Hunt Experience on an individual basis or as part of a group or team.  For group/team participation, the individual within such group/team who has purchased the game play materials for the Scavenger Hunt Experience shall be the Lead Contestant functioning as the authorized representative for all members of the group/team and as the sole liaison with Roamli as to the group’s/team’s participation in the Scavenger Hunt Experience. Lead Contestant assumes full responsibility for informing all Contestants who are members of his/her group/team of any information and materials provided to Lead Contestant by Roamli in conjunction with participation in the Scavenger Hunt Experience. The Lead Contestant must be 18 years of age or older (or the age of majority in his/her jurisdiction of residence, whichever is higher). Where a group/team plays through one member’s Roamli account (for example, the group’s/team’s Captain), that account holder must meet the same age requirement, has the responsibilities of the Lead Contestant under these Terms & Conditions, and represents that he/she has made these Terms & Conditions available to each other member of the group/team and that each of them has agreed to them. If a group/team includes a Minor, the Lead Contestant (or such account holder) represents that the Minor’s parent or legal guardian has approved the Minor’s participation and has accepted these Terms & Conditions on the Minor’s behalf, and the Minor may take part only through the Roamli account of the Lead Contestant or of another adult member of the group/team (or, for a Minor under 13, only as described in the Section titled “Participation by Minors; Parent/Guardian Consent”).

  2. Waiver and Release of Liability:

    1. I have independently investigated the risk of injury to myself from the activities involved with the Scavenger Hunt Experience (hereinafter collectively referred to as “Activities”), including the potential for permanent disability and death, and understand that, while particular rules, precautions, following provided instructions and personal discipline may reduce this risk, the risk of serious injury is an inherent risk in participation in the Activities;

    2. I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for said risks;

    3. On behalf of my heirs, assigns, personal representatives and next of kin and any other party who may take by or through me, I hereby release and hold harmless Roamli, its divisions and affiliated companies; Scavenger Hunt Experience producers, sponsors, organizers other than Roamli (to the extent applicable); their respective officers, officials, agents, employees, volunteers, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the Activities (“Releasees”), with respect to any and all injury, disability, death, or loss or damage to person or property incident to my or involvement or participation in the Activities, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law;

    4. I,  on behalf of my assigns, personal representatives and next of kin and any other party who may take by or through me, agree to defend, indemnify, and hold harmless all the above Releasees from any and all liabilities incident to my involvement or participation in the Activities, even if arising from their negligence, to the fullest extent permitted by law;

    5. I, on behalf of my assigns, personal representatives and next of kin and any other party who may take by or through me, agree to defend, indemnify, and hold harmless all the above Releasees for any and all claims made by any third-party entity or individual against any Releasee based, in whole or in part, upon any intentional or negligent action by me;

    6. I have read this release of liability and assumption of risk agreement, fully understand its terms, understand that we have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement;

    7. If I am injured or become ill in connection with the Activities and am unable to consent to treatment myself, I consent to any emergency medical treatment, including first aid and transport to a medical facility, that emergency responders or medical personnel consider necessary, and, if I accept these Terms & Conditions on behalf of a Minor, I give the same consent for the Minor as his/her parent or legal guardian. I accept responsibility for the cost of any such treatment and transport. I understand that the Releasees have no obligation to provide, arrange, or pay for medical care of any kind;

    8. I certify that I have not been advised to not participate by a qualified medical professional and that there are no health-related reasons or problems which preclude my participation in this activity being cognizant that such participation involves an not insignificant amount of outdoor activity (e.g., walking/running or cycling) for a period of several hours.

  3. Participation by Minors; Parent/Guardian Consent:

    PARENTS AND LEGAL GUARDIANS: READ THIS SECTION CAREFULLY. BY APPROVING OR ALLOWING A MINOR’S PARTICIPATION, YOU ACCEPT THESE TERMS & CONDITIONS, INCLUDING THE ASSUMPTION OF RISK, RELEASE OF LIABILITY, INDEMNITY, AND PUBLICITY AND USER CONTENT RELEASE, ON YOUR OWN BEHALF AND ON BEHALF OF THE MINOR, AND YOU GIVE UP SUBSTANTIAL RIGHTS.

    A Minor may participate in a Scavenger Hunt Experience only with the approval of his/her parent or legal guardian. If I am the parent or legal guardian of a Minor and I approve or allow the Minor’s participation in a Scavenger Hunt Experience (including by allowing the Minor to participate through my Roamli account or as a member of a group/team), I accept these Terms & Conditions on my own behalf and on behalf of the Minor, and I acknowledge, warrant and agree that:

    1. I am the parent or legal guardian of the Minor and have the legal authority to approve the Minor’s participation and to accept these Terms & Conditions on the Minor’s behalf; I have read and understand these Terms & Conditions, have explained them to the Minor as appropriate to the Minor’s age and understanding, and consent to the Minor’s participation;

    2. I have independently investigated the risks described in the Section titled “Waiver and Release of Liability” above as they apply to the Minor, including the potential for permanent disability and death, and I knowingly and freely assume all such risks, both known and unknown, on my own behalf and on behalf of the Minor, and assume full responsibility for said risks;

    3. ON MY OWN BEHALF AND ON BEHALF OF THE MINOR, AND ON BEHALF OF OUR RESPECTIVE HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN AND ANY OTHER PARTY WHO MAY TAKE BY OR THROUGH EITHER OF US, I HEREBY RELEASE AND HOLD HARMLESS THE RELEASEES (AS DEFINED ABOVE) WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY INCIDENT TO THE MINOR’S INVOLVEMENT OR PARTICIPATION IN THE ACTIVITIES, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING ANY CLAIM I MAY HAVE IN MY OWN RIGHT (SUCH AS FOR MEDICAL EXPENSES OR LOSS OF THE MINOR’S SERVICES OR SOCIETY);

    4. I agree to defend, indemnify, and hold harmless the Releasees from any and all liabilities and claims incident to the Minor’s involvement or participation in the Activities, including claims brought by or on behalf of the Minor (whether before or after the Minor reaches the age of majority) and claims by any third-party entity or individual based, in whole or in part, upon any intentional or negligent action by the Minor, even if arising from the negligence of the Releasees, to the fullest extent permitted by law;

    5. I certify that the Minor has not been advised to not participate by a qualified medical professional and that there are no health-related reasons or problems which preclude the Minor’s participation, being cognizant that such participation may involve a not insignificant amount of outdoor activity (e.g., walking/running or cycling) for a period of several hours;

    6. I am responsible for supervising the Minor, or for arranging supervision by a responsible adult whom I have authorized, as appropriate to the Minor’s age and maturity and to the nature, location, and duration of the Activities, and for ensuring that the Minor follows these Terms & Conditions, the Official Rules, and the Roamli Community Standards. I understand that Roamli does not undertake to supervise any Minor;

    7. The Minor will not create or hold a Roamli account. Where participation requires a Roamli account, the Minor will participate only through my account or the account of another adult whom I have authorized (such as the Lead Contestant or Captain of the Minor’s group/team), and I am responsible for all activity conducted through my account;

    8. On my own behalf and on behalf of the Minor, I grant the consent, license, waivers, and release set forth in the Section titled “Release of Photographs, Likenesses and User Content” below with respect to the Minor’s name, username or team name, image, likeness, and voice, any photographs, videos, or other recordings of the Minor made in connection with the Activities, and any User Content submitted by or on behalf of the Minor, and I may request deletion of the Minor’s User Content as described in the Section titled “Deleting User Content” below;

    9. If the Minor is under 13 years of age, then, notwithstanding the preceding items, the Minor may participate only through the Roamli account of an adult (me, or another adult whom I have authorized, such as a teacher, coach, or the Lead Contestant or Captain of the Minor’s group/team) who personally operates the account, submits all User Content, and supervises the Minor; no personal information about the Minor may be submitted, including in User Content (for example, the Minor’s name or contact details, or a photo, video, or audio recording in which the Minor can be identified); and the Minor will not provide personal information directly to Roamli (for example, by registering, messaging, or entering contact details). Nothing in these Terms & Conditions changes the Roamli Privacy Policy, under which Roamli does not knowingly collect personal information directly from children under 13;

    10. Roamli may require confirmation of my approval at any time and may refuse or end a Minor’s participation if such confirmation is not provided or if Roamli believes that the requirements of this Section are not met; and

    11. I understand that the laws of some jurisdictions limit the enforceability of a parent’s or legal guardian’s release, waiver, or indemnity with respect to a Minor’s claims. If any provision of this Section is held invalid or unenforceable as applied to the Minor, it shall be enforced to the maximum extent permitted by law, and all other provisions of these Terms & Conditions, including my own assumption of risk, release, and indemnity obligations, shall remain in full force and effect.

  4. Release of Photographs, Likenesses and User Content (Publicity and User Content Release):

    I understand that while participating in the Activities, I may be photographed, videotaped, or otherwise recorded, including by Roamli and by other Participants, and that I may submit User Content. By participating in the Activities, I hereby consent to the use of photographs, audio recording, and/or videotape of myself, and of my User Content, for publicity, promotional, and/or educational purposes (including publications and presentation or broadcast via newspaper, internet, or other media sources) as well as internal/archival purposes, to the fullest extent permitted by law, as further described in this Section.

    As between me and the Content Licensees (defined below), I retain ownership of any rights I have in my User Content. I hereby grant to Roamli and its successors and assigns, and to the agents, contractors, and service providers acting on Roamli’s behalf (collectively, the “Content Licensees”), a non-exclusive, worldwide, royalty-free, fully paid-up, perpetual license, sublicensable only to persons acting on Roamli’s behalf, to use, reproduce, display, publish, distribute, transmit, perform, edit, crop, adapt, translate, and create derivative works of my User Content and any photographs, videos, audio, or other recordings of me made in connection with the Activities, and to use my name, username, team name, image, likeness, and voice as contained in or in connection with any of the foregoing, in any and all media now known or later developed (including social media, websites, email, print, broadcast, and advertising), for social media, marketing, advertising, promotional, publicity, commercial, educational, internal, and archival purposes, including to promote the Scavenger Hunt Experience and Roamli and its goods and services. This license is perpetual, subject to the Section titled “Deleting User Content” below, which describes what continues after deletion.

    I do so with full knowledge and consent and waive all claims for compensation for use or for damages. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the Content Licensees, consistent with this Section. I waive any right to inspect or approve any use of my User Content or likeness or any materials in which they appear, and, to the fullest extent permitted by law, any moral rights or rights of attribution in my User Content. I release the Content Licensees from any and all claims for invasion of privacy, violation of the right of publicity, or misappropriation of name or likeness arising from any use permitted by this Section. No Content Licensee is obligated to use any User Content.

    I represent and warrant that I have the right to submit my User Content and to grant the license above, that I have obtained any permission required from each identifiable person who appears in my User Content (and, for any identifiable Minor, from his/her parent or legal guardian) for the uses described in this Section, and, if a group/team plays through my Roamli account, that each other member of the group/team has agreed to this Section. I further agree to allow my username and team name, together with my score and standing, to be displayed in leaderboards, standings, and results for the Scavenger Hunt Experience, and to allow my username to be publicly announced if I am the Official Winner of a Scavenger Hunt Experience.

  5. Deleting User Content:

    I may delete my User Content from Roamli at any time, for any reason, by emailing Roamli at info@roamli.com with enough information for Roamli to identify me, the Scavenger Hunt Experience, and the User Content concerned, or by using any deletion tool Roamli makes available on the Roamli platform. If I have accepted these Terms & Conditions on behalf of a Minor, I may do the same for the Minor’s User Content. Roamli will respond to a deletion request within 10 days of receiving it and, within 28 days of receiving it (or, if Roamli needs more information to verify the request, within 28 days of receiving that information), will remove the User Content from the Roamli platform, including from the Scavenger Hunt Experience, and Roamli will not make new uses of it.

    I UNDERSTAND AND AGREE THAT DELETION OPERATES ONLY FROM THE TIME IT IS COMPLETED AND ONLY WITH RESPECT TO THE ROAMLI PLATFORM. DELETION DOES NOT REQUIRE ROAMLI OR ANY OTHER CONTENT LICENSEE TO RECALL, REMOVE, OR CEASE ANY USE MADE BEFORE DELETION (FOR EXAMPLE, SOCIAL MEDIA POSTS, PUBLISHED ARTICLES, ADVERTISEMENTS, BROADCASTS, OR PRINTED MATERIALS), OR TO DESTROY OR RETURN ANY COPY DOWNLOADED, EXPORTED, OR OTHERWISE OBTAINED BEFORE DELETION, AND THE LICENSE GRANTED IN THE SECTION TITLED “RELEASE OF PHOTOGRAPHS, LIKENESSES AND USER CONTENT” CONTINUES TO APPLY TO THOSE USES AND COPIES.

    Roamli may retain deleted User Content in backup copies for a limited period in the ordinary course until they are overwritten, and to the extent reasonably necessary to comply with law, resolve disputes (including any Official Dispute), prevent fraud or abuse, or enforce these Terms & Conditions, and will use such retained copies only for those purposes. Deleting User Content may result in the loss of any points, Challenge completions, standings, rewards, or prize eligibility associated with it. Deleting my Roamli account does not by itself delete my User Content; to have User Content deleted, I must request its deletion as described above. If User Content submitted by someone else depicts me (or a Minor on whose behalf I have accepted these Terms & Conditions), I may ask Roamli to remove it from the Roamli platform, and Roamli will consider the request in good faith.

  6. Payment and Refunds:

    I acknowledge that any payment made to Roamli for participation in the Scavenger Hunt Experience is final and not subject to refund for any reasons other than those expressly described in these Terms & Conditions or Official Rules. I further acknowledge that any and all costs incurred in conjunction with participation in the Scavenger Hunt Experience are my sole responsibility; such costs include but are not limited to wireless Internet access charges and travel-related costs.

  7. Product:

    I acknowledge that I am purchasing the game play materials, which are to be used to take part in the Scavenger Hunt Experience. Any monetary incentive available to the Official Winner is a bonus and does not constitute the product being purchased. THE ONLY PRODUCT BEING PURCHASED ARE THE GAME PLAY MATERIALS, WHICH ARE TO BE USED TO TAKE PART IN THE SCAVENGER HUNT EXPERIENCE. I further acknowledge attaining the status of Official Winner requires the exercise of intellect, reasoning and critical thinking to properly comprehend and exploit the game play materials and complete Challenges comprising the Scavenger Hunt Experience.

  8. Taxes:

    I acknowledge that I am fully responsible for all applicable taxes on any monetary incentive that I receive in connection with the Activities. I understand that, as a condition precedent for receipt of any monetary incentive, I may be required to produce a completed form W-9 with my Social Security Number and/or other documentation required by State or Federal taxation authorities.

  9. Copyright:

    I acknowledge that all game play materials, website and platform content, and other content associated with the Activities (other than User Content, which is governed by the Sections titled “Release of Photographs, Likenesses and User Content” and “Deleting User Content”) are at all times the sole property of Roamli or its licensors, which grants to me a limited, nonexclusive, non-transferable, non-sublicensable, revocable, royalty-free license to use the Scavenger Hunt Experience Content solely for purposes of participation in the corresponding Scavenger Hunt Experience in accordance with these Terms & Conditions and the Official Rules. ANY OTHER USE OF THE SCAVENGER HUNT CONTENT, INCLUDING BUT NOT LIMITED TO REPRODUCTION OR PUBLICATION OF SAME, CONSTITUTES AN ACTIONABLE VIOLATION OF ROAMLI’S RIGHTS.

  10. Cancellation, Alteration, or Postponement of Scavenger Hunt Experience

    I acknowledge that Roamli may cancel the Scavenger Hunt Experience at any time for any reason beyond its control; a force majeure event (e.g., a natural disaster, pandemic/epidemic, civil commotion, riot, strike, act of fraud). In such case, I will receive a full refund. If a Scavenger Hunt Experience is cancelled, game play materials sold by Roamli for use in participating in such Scavenger Hunt Experience are void and should be discarded.

    I acknowledge that the Scavenger Hunt Experience may be postponed to a later date of Roamli’s sole choosing), and that refunds will not be issued in the event of a postponement, except at the sole discretion of Roamli.

  11. Limitation of Liability: 

    Roamli assumes no liability under any legal theory for:

    1. Scavenger Hunt Experience materials sent by or sent to Contestants that are late, lost, garbled, incomplete, inaccessible, blocked, corrupted, jumbled, misdirected, delayed, or damaged, regardless of cause (all of which are void);

    2. incomplete or inaccurate information whether caused by Contestants or any other party, tampering, hacking or by any equipment or programming associated with or utilized with the Scavenger Hunt Experience or by any technical or human error, malfunction or failure;

    3. any other error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of Scavenger Hunt Experience materials;

    4. any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, programming related to implementation of the Scavenger Hunt Experience.

  12. Severability:

    Should any provision of the Terms & Conditions be held invalid or unenforceable by a tribunal of competent jurisdiction for any reason or to any extent, such invalidity or enforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of the Terms & Conditions, and the application of that provision shall be enforced to the extent permitted by law. Any failure by Roamli to enforce the Terms & Conditions or any provision hereof shall not waive Roamli’s right to do so. As used in these Terms, the words “include” and “including”, and variations thereof, will be deemed to be followed by the words “without limitation.”

  13. Governing Law; Dispute Resolution:

    These Terms & Conditions and the Official Rules are governed by the laws of the State of Illinois, United States of America, without regard to choice or conflicts of law principles, and by the Federal Arbitration Act, as provided in Section 20 (“Disputes”) of the Roamli Terms of Use. Notwithstanding any other provision of these Terms & Conditions or the Official Rules, any dispute, claim, or controversy between me and Roamli that relates to or arises in connection with these Terms & Conditions, the Official Rules, or the Scavenger Hunt Experience is a “Dispute” under Section 20 (“Disputes”) of the Roamli Terms of Use and shall be resolved exclusively as provided in that Section, including by final, binding arbitration (subject to that Section’s exception for qualifying small claims court actions), and I agree to that Section’s waiver of trial by jury and its waiver of class, consolidated, and representative actions. If for any reason a Dispute proceeds in court, the jurisdiction and venue provisions of that Section apply. In any such arbitration or action, I agree that my recovery shall be limited to a refund of the purchase price of game play materials for the Scavenger Hunt Experience, with special, compensatory, punitive, consequential and other damages, attorneys’ fees, as well as any right to equitable or injunctive relief (including any remedy by which I may suspend or interrupt an ongoing Scavenger Hunt Experience) being specifically waived. I additionally agree, to the fullest extent permitted by law, to bring any such action solely on an individual basis and agree not to seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity.
